Terms and conditions of the foen.pl store

1. General conditions

1.1. The foen.pl online store, hereinafter referred to as the Store, located on the website at www.foen.pl, allows purchases via the internet. The store is run by: Foen Scent Sp. Z O.O., ul. Krakowska 29D, 50-424 Wrocław, with NIP /Tax Identification Number/ 8992902140.

1.2. Information about goods provided on the Store’s website, especially their descriptions, technical and user parameters, and prices, constitute an invitation to enter into a contract, as per Art. 71 of the Civil Code.

1.3. The price information on the Store’s website is binding from the moment the Customer receives an email containing the final confirmation of all essential elements of the Order until the Order is executed.

2. Rules for using the store

2.1. Orders can be placed by filling out the order form after previously adding products to the cart. The primary condition for executing purchases is the correct completion of the order form provided by the Store on its website. The Customer is obliged to provide a contact phone number and an email address where order confirmation is possible. Incorrectly completed order forms will not be processed.

2.2. When placing an Order through the form on the Store’s website, before pressing the “Buy and Pay” button, the Customer can modify the entered data and the choice of goods. To do this, follow the displayed messages and information available on the site.

2.3. To send the Order, it is necessary to accept the terms and conditions, provide the mandatory personal data, and press the “Buy and Pay” button.

2.4. Sending the Order by the Customer constitutes a declaration of intent to conclude a Sales Agreement in accordance with the terms and conditions.

2.5. After placing the Order, the Customer receives an email summarizing the order.

2.6. The contract is considered concluded when the Customer receives an email containing the final confirmation of product availability and all essential elements of the Order.

2.7. The Store reserves the right to reject the purchase offer without giving reasons – it undertakes to promptly notify the Customer of such a situation.

2.8. The Store reserves the right to suspend the processing of orders that raise doubts.

2.9. Orders can be placed 24 hours a day throughout the entire year.

2.10. Order processing time – Products with the “In stock” status are shipped within 1 – 7 business days after placing the order. Products with the “Extended processing time” status are shipped after replenishing the stock from the manufacturer’s warehouse, and the processing time depends on the availability in the manufacturer’s warehouse.

2.11. The store reserves the right to withdraw certain products listed on the store’s pages from sale.

2.12. Prices of goods in the Store are given in Polish zloty (PLN) and include VAT (gross prices). Every transaction is concluded with a VAT invoice, which is included with the shipment.

2.13. To ensure the security of message and data transfer related to the services provided on the website, the Online Store takes technical and organizational measures appropriate to the degree of threat to the security of the services, especially measures to prevent unauthorized persons from acquiring and modifying personal data transmitted online.

2.14. After shipping the purchased goods, the Store, as part of the contract execution with the Customer, is authorized to send an invitation to the Customer’s email address to complete a survey to assess their experience of the transaction. The Customer has the right, but is not obligated, to complete it.

3. Shipping and Payment

3.1. Purchased goods are delivered to the address specified in the order form or to the parcel locker indicated in the order form.

3.2. The customer has the right to choose the method of delivery, according to the order form.

3.3. The Customer covers the shipping costs of orders. They depend on the type of shipment and the weight of the ordered goods. A detailed list of shipping costs is provided in section 3.13.

3.4. The times in which the ordered goods are shipped are determined by point 2.10 of these Terms and Conditions unless other delivery terms are agreed upon during order confirmation.

3.5. The store does not ship on Saturdays, Sundays, and public holidays.

3.6. The method of payment and shipment is chosen by the Customer when placing the order. The order is processed after the full amount is credited to the Store’s account or, when choosing cash on delivery.

3.7. Payments for purchased goods can be made: – on delivery – payment is collected by the postman or courier upon delivery; – by electronic transfer through secure online payments (Tpay).

3.8. To ensure the best service and security, credit card payments are authorized within 24 hours, which may slightly delay the transaction.

3.9. The maximum credit card payment amount is PLN 7,000. For purchases of higher value, please contact us in advance.

3.10. The maximum payment amount for cash on delivery and DHL courier shipment is PLN 5,500 gross. It is possible to order more expensive goods and pay on delivery – in this case, however, the courier does not deliver the goods to the specified address; the customer is obliged to collect and pay for the ordered goods at the nearest DHL branch.

3.11. Courier delivery guarantees delivery within 24 – 48 hours. The package is insured, and its contents can be checked upon receipt without additional charges. When the shipment is sent, the Customer receives a confirmation with a tracking number, allowing them to monitor it at every stage through the courier’s website.

3.12. Priority shipment sent by Polish Post is not a guaranteed shipment. This means that, according to the regulations of the Polish Post, the priority package should reach the recipient the next business day, but the maximum delivery time is up to 14 business days. Only after this period can a complaint be filed.

3.13. Shipping Costs: Detailed shipping costs are presented in the cart table when placing an order.

The delivery conditions mentioned apply to the territory of the Republic of Poland.

3.14. To place an order with a delivery address outside the borders of the Republic of Poland, please contact the Store to determine separate delivery conditions.

3.15. In case of detecting mechanical damage or incompleteness of the package contents, please contact the Store.

4. Warranties and Complaints

This section defines the complaint procedure common to all complaints submitted to the Seller, especially complaints about Products, Sales Agreements, Electronic Services, and other complaints related to the Store’s operation.

4.1. Goods offered in the Store are free from defects, are covered by manufacturers’ warranties, and come with appropriate warranty cards. In some cases, the only basis for the warranty is proof of purchase (invoice).

4.2. If a non-conformity of the goods with the contract is found within 2 years from the date of issue, the Customer has the right to exercise the rights arising from the Act of July 27, 2002, on specific conditions of consumer sales and amendments to the Civil Code. The above term starts anew in the case of exchanging goods as non-conforming to the contract. The Customer can report the non-conformity of the goods with the contract in writing to the Store’s address, electronically to the email address info@foen.pl, or to the manufacturer’s address.

4.3. In the event of a discrepancy between the services offered by the Store and the contract within 2 years from the date of issue, the Customer has the right to exercise the rights arising from the Act of July 27, 2002, on specific conditions of consumer sales and amendments to the Civil Code. The above term starts anew in the case of exchanging goods as non-conforming to the contract. The Customer can report the non-conformity of the service with the contract in writing to the Store’s address or electronically to the email address info@foen.pl.

4.4. In the event of a complaint to the Store, the Store will respond to the complaint within 14 days from the day of its receipt in the same form in which the complaint was submitted.

5. Right to Withdraw from the Contract

5.1. The Consumer has – based on legal provisions – the right to withdraw from the contract without giving a reason, by submitting an appropriate statement in writing, within 14 days from the delivery of the goods, and sending it to the Store’s address provided in these Regulations (by traditional mail or electronically).

5.2. The deadline for withdrawing from the contract expires after 14 days from the day on which the Customer took possession of the goods or on which a third party, other than the carrier and indicated by the Customer, took possession of the goods.

5.3. The right to withdraw from the contract by the Consumer is excluded for goods ordered specially for the Customer (beyond the universal offer).

5.4. In the event of withdrawal from the contract, the contract is considered not concluded. Products provided by the parties shall be returned in an unchanged state and condition. The Customer is obliged to immediately return the purchased goods to the following address: Foen Scent Sp. Z O.O., ul. Krakowska 29D, 50-424 Wrocław. In the case of a full order return, the Store will refund all payments received from the Consumer, including the cost of delivering the goods to the recipient (excluding additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest ordinary delivery method offered by the Store) to the bank account number provided by the Customer within 14 calendar days from the date the Store receives information about the decision to exercise the right to withdraw from the contract. In the case of a partial return of the order (e.g., one of the three ordered goods), the Store is only obliged to refund the price of the goods.

5.5. The goods should be returned in the same state and completeness in which they were purchased, along with the instruction and warranty. The Customer can fill out and send the return form or any other unequivocal statement electronically to the email address: info@foen.pl or by mail to the Store’s address. All returns and shipments sent at the Store’s expense are not accepted unless other arrangements have been made previously.

5.6. The goods returned by the Customer should be packaged in a way that ensures no damage during transport.

5.7. The Customer bears the cost of packaging and returning the goods.

5.8. The right to withdraw from the contract is granted only to Consumers. If the Customer is a Company, the possibility of return is considered individually each time.

6. Personal Data and Privacy Policy

6.1. When using the Store, it is required to provide your personal data: – When starting a newsletter subscription, only an email address is required, – Full contact details are necessary when registering (creating an account) in the Store and when placing an order.

6.2. By providing personal data, the customer consents to their processing for order fulfillment purposes by the owner of the Store – Foen Scent Sp. Z O.O., ul. Krakowska 29D, 50-424 Wrocław, using the tax identification number (NIP) 8992902140 (in accordance with the applicable provisions of the Personal Data Protection Act of August 29, 1997, and the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)). Data may be transferred to our sales representatives, entities that provide support and operation of our IT tools and systems, carry out shipments, provide ongoing legal service, and the company responsible for document destruction.

6.3. Not providing the required data will result in the inability to perform the actions they pertain to.

6.4. Providing data is voluntary, but necessary to place an order.

6.5. Personal data will be stored until the sales contract is executed, and until the claims arising from it expire, and until obligations arising from tax and accounting regulations are fulfilled.

6.6. Every customer has the right to access their data and correct or delete it. Simply contact Foen Scent Sp. Z O.O., ul. Krakowska 29D, 50-424 Wrocław, using the tax identification number (NIP) 8992902140 regarding data protection at the email address: info@foen.pl.

7. Final Provisions

7.1. Any disputes arising between the Store and the Customer will be submitted to the competent courts in accordance with the provisions of the relevant Civil Procedure Code.

7.2. Matters not covered by these Regulations are governed by the Civil Code, the Act on Providing Services by Electronic Means, and other relevant provisions of Polish law.

7.3. The Store reserves the right to amend the Regulations at any time. Customers making purchases in the Store are obligated to familiarize themselves with and accept the current version of the Regulations each time. The current version of the Regulations is also available in PDF format with the date from which it is in force. Changes to the Regulations cannot violate the acquired rights of Customers using the Store.
